These General Conditions establish the terms for contracting the services offered on the website www.katalystbycodurance.com, owned by CODURANCE, S.L. (hereinafter, CODURANCE).

The contracting of any of the services implies total and unconditional acceptance of the General Conditions detailed herein, as well as any Particular Conditions that may apply in certain cases.

These General Conditions may be modified without prior notice, so it is recommended to review them before contracting any service.

Services Offered

CODURANCE offers programming, consulting, and IT-related services under the brand Katalyst by Codurance, owned by CODURANCE.

The available services, along with their main features, are detailed on the website and are accessible by subscription, with the price visible on the screen.

CODURANCE reserves the right to add or withdraw services from its offer at any time without prior notice.

To acquire a service, the USER must register, receiving a username and password that will allow access to the contracted services.

Access to the services requires following the instructions of the purchase process, which includes the acceptance of the general and particular conditions published on www.katalystbycodurance.com.

CODURANCE will do its best to ensure the availability of the offered courses.

The Client will be able to access the purchased courses for a period of 12 months from the confirmation of the purchase, as long as the account remains active and CODURANCE retains the corresponding license.

Access credentials are personal and non-transferable, and sharing them may lead to penalties.
Companies must acquire an individual account for each employee; sharing an account among multiple employees is not allowed. Access licenses will be owned by the contracting company, so in the event of the departure of one of its users, the license may be associated with another user, provided it remains within the previously established time frame.

CODURANCE will not be responsible for interruptions or failures in telecommunications that affect the service of www.katalystbycodurance.com.


To protect the intellectual property of the content, downloading or copying the courses is prohibited.
 

Service Quality

CODURANCE offers training delivered by qualified professionals, although completing a course does not guarantee full mastery of the content.

 

Contracting and Billing of Services

To make purchases on www.katalystbycodurance.com, the customer must be of legal age and register by providing truthful, complete, and up-to-date information.

The subscription process is detailed below:

For Individual Clients:

  1. Access www.katalystbycodurance.com.
  2. Create an account and select the desired course.
  3. Confirm the purchase and make the payment.
  4. Once payment is confirmed, the user will be sent access to the course and the corresponding invoice.


For Companies:
Companies must contact CODURANCE directly via info@katalystbycodurance.com to receive information and conditions regarding the services.

The customer (company and individual) will receive the invoice by email in PDF format once payment is validated and the service is activated.

 

Payment Methods

The available payment methods are:

  • Credit or debit card: Immediate payment through a secure SSL gateway. In case of a refund, the amount will be refunded to the same card.
  • Bank transfer: Only available for companies, which will receive banking details via email.

No payment method incurs additional charges.

Service Prices and Taxes

The prices of the services are displayed in euros, unless otherwise indicated, and are guaranteed during the specified validity period.

VAT (21%) is not included in the displayed prices and will be added during the purchase process.

The final price will be confirmed to the customer before completing the purchase.

 

Returns or Cancellations

According to general regulations, the user has the right to withdraw from the contract within 14 calendar days as provided in articles 107.2 and 108 of Royal Decree 1/2007, of November 16, which approves the referred text of the General Law for the Defense of Consumers and Users.

This right of withdrawal does not apply to the services provided by CODURANCE as they are covered by the exception established in letter m) of Article 103 of the aforementioned Law: “The supply of digital content not provided on a tangible medium when the execution has begun.”

 

Liability

The Client must complete the courses following the instructions. Sharing accounts or copying content is not allowed.

Any illegal activity may lead to the cancellation of the account and legal action by CODURANCE.

CODURANCE reserves the right to suspend or cancel services at any time without prior notice.

Applicable Legislation and Jurisdiction

These conditions will be governed by current Spanish legislation.

In the event of a dispute, the parties expressly submit to the Courts of Barcelona (Spain), expressly waiving their own jurisdictions if they have any.

The language used will be Spanish.

 

Personal Data Protection

In accordance with Regulation (EU) 2016/679 of April 27, General Data Protection Regulation (GDPR) and Organic Law 3/2018 of December 5, on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD), we inform you that the personal data provided will be processed by CODURANCE, S.L., with CIF B66815606, and with address at C/ Pallars, 99 Of. 41, 08018 Barcelona (Spain).

The purpose of processing is to contact you if necessary and to provide you with the necessary access to the purchased courses managed through the e-learning platform (Moodle) and our CRM (HubSpot). The legal basis for the processing of your data is compliance with a legal obligation. Your data will not be transferred to third parties except by legal obligation or in cases where it is necessary for the provision of the service.

You have the right to access, rectify, delete, oppose, and limit the processing of your data, as well as to request the portability of the same, by contacting info@katalystbycodurance.com or our registered address. If you believe that your rights have not been respected, you can file a complaint with the Spanish Data Protection Agency (AEPD).
